My father had my mother (who was a stroke victim) in a nursing home under medicaid/dhs support. He passed away 2 years ago, and the estate is finally going to close.
There is going to be about 60,000 in cash, and multiple vehicles, legitimately worth about 60,000 (though one is a rare sports car and would require a lot of steps to get max value) My understanding from my lawyer and the team I have spoken to is the moment the money is released, that the subsidize nursing home payments and her free medical care will go away, and we will be paying all her bills out of the estate until the money is gone. At that time the support would kick back in.
The nursing home alone will be near 7,000 a month after this happens. That means assets will be gone in about 2 years. Besides her mind, and inability to walk, my moms health is such that she is probably going to live another 10 years.
I do not need or want any of the money. I am my mom's legal guardian and I of course have gotten involved in all of this, but I now wish I had known better from the start. The issue I have is the cars, and one near new Harley Bike.
I don't expect or desire anything from this estate. I was told by one DHS worker that I would need to sale her cars, and make sure I got fair value or my mom's support would end. Why do I need to do this? I live far away from any city. The effort and money required on my part to sale these vehicles is not worth it. Even if I am allowed to bill the estate for the work, I don't see the need to waste any of my time going to an auction or going through any more steps.
Do I have any options where I can walk away? I don't want to lose rights to my mothers care, but I struggle with the idea of spending any more of my time (and I have spent a LOT of my time the last two years going through my dads nightmare bills and assets) working on this. I don't want to waste another weekend trying to get fair value out of a vehicle that is just going to go right to the state anyway. I feel like I am being asked to work for nothing, because again there is no way I am going to see any of these assets.
So what can I do here? Is it possible to turn over the entire estate after the judge closes it to someone in the government and let them deal with it?
