They already threw out a case in West Virginia.
Ok, so Dems worked hard to bring up a Byrd rule complaint on the part of the Big Beautiful Bill stopping Medicaid support of trans care. Katelyn Burns reports that this is due to the work of Senator Tammy Baldwin and Representative Sarah McBride, our first lesbian Senator and our first trans representative.
Republicans could have brought this up for a vote but it sounds like they didn’t even bother with that.
The problem is that Republicans aren’t done threatening Medicaid coverage of trans care, the Supreme Court just threw out a lower court decision on this in West Virginia. The decision was based on a definition of sex discrimination the Supreme Court doesn’t recognize after their decision on the Tennessee trans bans.
Its worth saying that the Supreme Court only sent the case back to appeals, they didn’t say Medicaid coverage of trans care is unconstitutional.
BUT it is strange this decision got made yesterday just before the Big Beautiful Bill got passed.
One can’t help wondering if the Supreme Court is trying to make up for the fact that the BBB can’t stop Medicaid…
